These Terms and Conditions ("Terms") govern access to and use of the BURJAUTO website (the "Website") and the purchase of products through the Website by private and business customers worldwide. By accessing, browsing, registering an account, or placing an order, you confirm that you have read, understood, and agree to be legally bound by these Terms.

1. Definitions

For the purposes of these Terms:

• "Seller" means the legal entity operating the BURJAUTO online marketplace.
• "Buyer" means any individual or legal entity that places an order through the Website.
• "Consumer" means an individual purchasing Products for personal, non-commercial use.
• "Business Customer" means a legal entity or individual acting in the course of trade or profession.
• "Products" means automotive spare parts and related goods offered for sale on the Website.
• "DAP / DDU" means Delivered at Place / Delivered Duty Unpaid, under Incoterms®, whereby import duties, taxes and customs charges are not included in the Product price.
• "Importer of Record" means the party responsible for customs clearance and payment of import duties and taxes in the destination country.

 

2. Scope of Application

These Terms apply to all orders, transactions, and uses of the Website.

By placing an order, the Buyer accepts the version of the Terms in force at the time the order is submitted. Any special conditions agreed individually in writing shall prevail over these Terms.

 

3. Eligibility and Account Registration

Use of the Website is permitted only to persons aged eighteen (18) years or older who have the legal capacity to enter into binding contracts.

Buyers may create a personal or business account. The Buyer is responsible for ensuring that all registration information is accurate, complete, and up to date, and for maintaining the confidentiality of login credentials.

The Seller shall not be liable for losses arising from unauthorized account access, except where caused by the Seller’s gross negligence or willful misconduct.

 

4. Marketplace Nature and Product Information

The Website operates as an international marketplace for automotive spare parts.

The Seller does not provide vehicle-specific advisory or verification services. Product descriptions, OEM numbers, compatibility references, and images are provided for identification and informational purposes only and may not reflect the exact appearance of the delivered Product.

The Buyer bears full responsibility for selecting the correct Product, verifying compatibility, and ensuring suitability for the intended use.

 

5. Prices, Currency and Payments

All prices displayed on the Website are exclusive of:

• import duties and customs charges;
• VAT, GST, sales tax or similar indirect taxes in the destination country;
• courier disbursement, handling or administrative fees.

Prices are displayed in the currency indicated on the Website. Exchange rates are applied for reference only and may differ from rates used by payment providers or banks.

Payment for Products and shipping costs must be made in full at the time of order placement. Orders are processed only after cleared payment is received.

 

6. Stock Availability and Order Confirmation

Product availability is subject to change without notice. An order confirmation does not constitute acceptance of the order if the Product becomes unavailable.

If a Product is unavailable after payment, the Seller shall refund the amount paid for that Product or credit it to the Buyer’s account balance, at the Buyer’s choice

 

7. Order Modifications and Cancellation

Once an order is placed, it cannot be modified.

An item may be cancelled only while its status is marked as “New” in the Buyer’s account. Orders with the status “Placed”, “Purchased”, or “Shipped” cannot be cancelled.

Cancelled items are credited to the Buyer’s account balance. Account balances do not expire.

 

8. Shipping Terms

Unless expressly agreed otherwise in writing, all international shipments are made on a DAP / DDU basis.

Any costs arising from return shipping, storage or disposal shall not be borne by the Seller.

 

9. Customs Duties, Taxes and Import Responsibilities

Prices displayed on the Website exclude import duties, customs charges, VAT/GST, sales tax, or any other taxes imposed by the country of destination.

The Customer acts as the Importer of Record and is solely responsible for compliance with all applicable import laws and regulations, as well as for the payment of all applicable import duties, taxes, and customs clearance fees.

The Seller does not act as a customs broker, tax agent, or importer and does not collect or remit import duties or taxes on behalf of the Customer.

 

10. Failure to Pay Import Charges

Failure or refusal by the Customer to pay applicable import duties, taxes, or customs charges shall constitute a refusal of delivery by the Customer. In such cases, no refunds shall apply.

 

11. Delivery, Transit Time and Risk Transfer

Delivery times provided by carriers are estimates only and are not guaranteed. Delays may occur due to customs inspections, regulatory requirements, force majeure events or carrier operations.

Risk of loss or damage to the goods passes to the Customer upon dispatch of the shipment to the carrier.

Delays or non-delivery resulting from customs procedures, regulatory actions, or the Customer’s failure to provide required documentation or payments are outside the Seller’s control.

 

12. Damaged or Lost Shipments

If Products arrive visibly damaged, the Buyer must notify the Seller within seven (7) calendar days of delivery and provide reasonable evidence.

The Seller’s liability for transit damage, if any, is limited to the extent of compensation recoverable under the applicable carrier’s claims and insurance procedures.

 

13. Returns and Refunds

Returns or refunds are not accepted for incorrectly ordered Products, including errors in part number selection or compatibility.

No refunds shall be issued where delivery becomes impossible due to:

• non-payment of import duties or taxes;
• failure to comply with customs or import requirements;
• refusal to accept delivery.

Refunds, where applicable, are processed to the original payment method or credited to the Buyer’s account within approximately 7–14 business days.

Refund eligibility, if any, is governed by the Return & Refund Policy, which shall be read in conjunction with these Terms & Conditions.

 

14. Limitation of Liability

To the maximum extent permitted by law, the Seller shall not be liable for any losses, penalties, delays, or costs arising from customs clearance processes, import regulations, or the Customer’s failure to comply with applicable laws in the destination country.

The Seller’s total liability shall in all cases be limited to the amount actually paid by the Buyer for the Products.

 

15. Force Majeure

The Seller shall not be liable for failure or delay caused by events beyond reasonable control, including acts of customs authorities, regulatory changes, labor disputes, transport disruptions, natural disasters or communication failures.

 

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai shall have exclusive jurisdiction.
